These terms and conditions of sale are concluded on the one hand by the company KEMI INVEST SAS with a share capital of 1000 € whose registered office is located in Asnièressur-Seine, registered in the Trade and Companies Register of Nanterre under number 908 926 843 hereinafter referred to as "KEMI INVEST" and managing the site Coptic Icons Gallery and, on the other hand, by any person or entity wishing to make a purchase via the website https://coptic.gallery hereinafter referred to as "the buyer.

Article 1. Purpose 

These conditions of sale are intended to define the contractual relationship between KEMI INVEST and the buyer and the conditions applicable to any purchase made through the website https://coptic.gallery. The acquisition of a product through this site implies acceptance without reservation by the buyer of these conditions of sale which the buyer acknowledges having read prior to his order. Before any transaction, the buyer declares on the one hand that the purchase of products on the site Coptic Icons Gallery is not directly related to his professional activity and is limited to a strictly personal use and on the other hand to have full legal capacity, allowing him to commit under these terms and conditions. 

The company KEMI INVEST retains the ability to modify at any time these conditions of sale, in order to comply with any new regulations or in order to improve the use of its site. Therefore, the applicable conditions will be those in force at the date of the order by the buyer.

Article 2. Products 

The products offered are those listed on the https://coptic.gallery website of the company KEMI INVEST, within the limits of the products offered by the artists. KEMI INVEST reserves the right to modify the range of products at any time. Each product is presented on the website in the form of a description of its main technical characteristics. The photographs are as accurate as possible but are not binding on the Seller, as the artist may adapt his work, in particular but not exhaustively, to the size selected or to the specific requests of the buyer. It is specified that the size of the products is likely to differ from the dimensions presented on the site at the discretion of the artist in particular to preserve the proportions of the final work.

The sale of products presented on the site https://coptic.gallery is intended for all buyers residing in countries that fully authorize the entry of these products into their territory.

Article 3. Prices 

The prices appearing on the product sheets of the internet catalogue are prices in Euros (€) including all taxes (TTC) taking into account the VAT applicable on the day of the order. Any change in the rate of VAT may be reflected in the price of products. The company KEMI INVEST reserves the right to change its prices at any time, although it is understood that the price listed in the catalog on the day of the order will be applicable to the buyer. The prices quoted do not include shipping costs, charged in addition to the price of products purchased according to the total amount of the order. In metropolitan France, for any order, shipping costs are offered.

Article 4. Order and payment terms 

Before ordering, the buyer must create an account on the site. The account creation section is accessible directly from the side menu bar. At each visit, the buyer, if he wants to order or view his account (status of orders, profile ...), will have to identify himself using this information. The company KEMI INVEST offers the buyer to order and pay for its products in several steps, with a single payment option to choose by secure payment by Stripe via credit card (via the STRIPE system): the buyer selects the products he wants to order in the "basket", modify if necessary (quantities, references ...), check the delivery address or fill in a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the mode of transport. The next step proposes to verify all the information, to read and accept the present general conditions of sale by checking the corresponding box, then invites him to validate his order by clicking on the button "Confirm my order". Finally, the buyer is redirected to the secure STRIPE interface in order to enter his personal credit card details in complete security. If the payment is accepted, the order is recorded and the contract is definitively formed. Payment by credit card is irrevocable. In the event of fraudulent use of the card, the buyer may demand the cancellation of the payment by card, and the sums paid will then be credited back or refunded. The responsibility of the bank card holder is not engaged if the disputed payment has been proven to have been made fraudulently, at a distance, without physical use of the card. To obtain reimbursement of the fraudulent debit and any bank charges that the transaction may have generated, the cardholder must dispute the debit in writing with his or her bank within 70 days of the transaction, or even 120 days if the contract binding him or her to the bank so provides. The amounts debited are reimbursed by the bank within a maximum of one month after receipt of the cardholder's written objection. The holder shall not be liable for any costs incurred in returning the sums.

The confirmation of an order implies acceptance of these terms of sale, the recognition of having perfect knowledge of them and the renunciation to take advantage of its own conditions of purchase. All the data provided and the recorded confirmation will be considered as proof of the transaction. If the buyer has an e-mail address and if he has provided it on his order form, the company KEMI INVEST will send him by e-mail confirmation of the registration of his order.

Article 5. Reservation of ownership 

The company KEMI INVEST retains full ownership of the products sold until full payment of the price, in principal, fees and taxes included.

Article 6. Withdrawal 

Under the Consumer Code, each product being a unique and personalized work, made to order, no retraction is possible. This provision does not deprive the buyer of the right to return the product in case of defects or faults on the delivered product.

Article 7. Delivery 

Deliveries are made to the address indicated on the order form, which can only be in the agreed geographical area. Orders are made by a carrier with a delivery service with tracking, delivery without signature. Delivery times are given only as an indication; if they exceed six months from the order, the sales contract may be terminated and the buyer reimbursed. The company KEMI INVEST may provide by e-mail to the buyer the tracking number of his package. The buyer is delivered to the address indicated at the time of the order. In case of absence of the buyer, it will receive a notice of passage, which allows him to withdraw the products ordered at the nearest point of withdrawal, during a specified period. The risks associated with transport are borne by the buyer from the time the items leave the premises of the company KEMI INVEST. The buyer is required to verify in the presence of the deliveryman, the condition of the packaging of the goods and its contents on delivery. In case of damage during transport, any protest must be made to the carrier within three days from delivery.

Article 8. Guarantee 

All products supplied by KEMI INVEST are covered by the legal guarantee provided by Articles 1641 et seq. of the Civil Code. In the event of non-conformity of a product sold, it may be returned to KEMI INVEST, which will take it back, exchange it or refund it. All claims, requests for exchange or refund must be made by email to the following address: contact@coptic.gallery within thirty days after delivery.

Article 9. Responsibility 

The company KEMI INVEST, in the process of distance selling, is bound only by an obligation of means. His responsibility can not be held liable for any damage resulting from the use of the Internet such as data loss, intrusion, viruses, service failure, or other unintended problems.

Article 10. Intellectual Property 

All elements of the site https://coptic.gallery are and remain the exclusive intellectual property of the company KEMI INVEST. No one is allowed to reproduce, exploit or use in any capacity whatsoever, even partially, elements of the site whether in the form of photo, logo, visual or text.

Article 11. Personal data

The company KEMI INVEST undertakes to preserve the confidentiality of information provided by the buyer, it would be required to transmit for the use of certain services. Any information concerning him is subject to the provisions of Law No. 78-17 of 6 January 1978. As such, the Internet user has the right to access, modify and delete information concerning him. Article 12. Settlement of disputes 

The present conditions of remote sale are subjected to the French law. For all disputes or litigation, the competent court will be that of Nanterre.
